What data I receive when you visit this site or contact me, why I need it, who it is shared with and how to have it deleted.
Who is responsible for your data
Website owner: Vitalii Kotenko, NIF Y2941312V, real estate agent, Finestrat (Alicante), responsible for the site's visit statistics.
The data you share when you message or call me about buying, selling or renting a home is controlled by the agency I work with: RE/MAX Inmomás II (Grupo Inmomás, CIF B54829767), CC La Marina, Finestrat (Alicante). How the agency handles data is described in its privacy policy (in Spanish).
On the south new-build pages (Vega Baja, Torrevieja, Santa Pola) the WhatsApp and Call buttons connect you with Nataliia Kuksenok, a RE/MAX Inmomás agent, Calle Conrado del Campo 16, Elche (Alicante), who works on my team. The data you share with her is handled by her and the agency she works with to answer your request.

What data I receive
I only receive what you send me yourself through the form on this site, on WhatsApp, Telegram, by email or by phone: your name, phone number, email address, the text of your message and what you are looking for. A form request also carries the page where your visit started and the link or ad tags (utm, gclid), so I know where the request came from. A WhatsApp message sent from the site gets a short page code added, which you can delete.
If you allow analytics, Google Analytics collects visit statistics: which pages were opened, on what device and where the visit came from, and Microsoft Clarity records scrolling, clicks and movement on the page (session recordings and heatmaps). Clarity does not record what you type in form fields. If you allow advertising, Google Ads learns that a visit after an ad click ended in a request and may show my ads to people who have visited the site; the Meta pixel (Facebook and Instagram) works the same way: it records page views and contact via WhatsApp, phone, Telegram or the form. If you then send the form, the email and phone number from your request are passed to Google Ads in encrypted (hashed) form, only to count the request that came from the ad (enhanced conversions). This data does not tell me who you are.
Why and on what legal basis
To answer your request, shortlist properties, arrange viewings and support you through the purchase. Legal basis: your request and steps prior to a contract (Art. 6.1.b GDPR).
To meet the legal obligations of real estate agents, including Spanish anti-money-laundering law (Ley 10/2010). Legal basis: Art. 6.1.c GDPR.
To understand which pages are useful and which ads bring requests. Legal basis: your consent to analytics and advertising cookies, given separately for each purpose (Art. 6.1.a GDPR), which you can withdraw at any time.
Who your data is shared with
Developers, sellers and their sales teams when a viewing or reservation needs to be arranged, and only with your knowledge. At the purchase stage, the notary, bank, lawyer or valuer if you ask me to.
The services this site, my email and my ads run on: Google (Google Workspace, Google Analytics and Google Ads), Meta Platforms (Meta pixel), Microsoft (Clarity) and Cloudflare (website hosting). These companies may process data in the United States; transfers are covered by the EU-US Data Privacy Framework and the European Commission's standard contractual clauses.
If you message me on WhatsApp or Telegram, those apps process the conversation under their own policies.
Your data is never sold or used for third-party advertising.
How long it is kept
For as long as I am working on your request. If no purchase takes place, contact details are deleted when you ask, and in any case no later than three years after our last contact.
If a purchase takes place, documents are kept for as long as the law requires: ten years under Ley 10/2010.
Your rights
You can ask to access, correct or delete your data, restrict or object to its processing, receive it in a portable format, and withdraw your consent. Write to vitali@vitalikotenko.es; I reply within one month.
If you believe your rights have not been respected, you can complain to the Spanish Data Protection Agency: aepd.es.
Cookies
Analytics cookies (Google Analytics, Microsoft Clarity) and advertising cookies (Google Ads, Meta pixel) are only set after you click “Allow” or turn the purpose on under “Settings”. If you decline, the site works the same, no statistics are collected and Clarity is not loaded.
